Death Sentence handed to Pervez Musharraf from Special court for high treason
In the high treason hearing case against former president Musharraf in a special court Islamabad on Tuesday (17-december-2019) was handed a death sentence under the Article 6 of the Constitution of Pakistan and Section 2 of high court Treason Act for professing the state of emergency on November 03 2007.
As per sources of Media the bench which heard the case included:
- Justice Waqar Ahmed Seth of Peshawar high court
- Justice Shahid Karim of Lahore high court
- Justice Nazar Akbar of Sindh high court
Two of Three judges gave their decision against Pervez Musharraf which included PHC’s Justice Waqar Seth and LHC’s Justice Shahid Karim but SHO’s Justice Nazar Akbar decision differed from both.
In hearing PHC’s Justice Waqar Seth said that the former ruler had disobey the Constitution of Pakistan by professing the state of emergency.
In the hearing of December 5 2019, the court reported that it will publish the verdict on December 17 2019 even if arguments of both the sides are not concluded (completed) by then.
However, on 18 march 2016 the ex-president Musharraf left Pakistan for his medical treatment to Dubai after his name being removed from the exit control list and has never returned to Pakistan after then.
On 17-December-2019 after the verdict was announced (DGISPR) Director General Asif Ghafoor said that this verdict has been came by “a lot of pain and anguish within the rank and file of Pakistan armed forces”
(DGISPR) Director General Asif Ghafoor said that “A man who has served his country for over 40 years, who has fought wars in defense of the state can surely never be a traitor”.
He added “The due legal process seems to have been ignored including constitution of special court denial of fundamental right of self-defense, undertaking individual specific proceedings and concluding the case in haste”.
He meant that the special court has given the decision in such a hurry without giving the fundamental right of self-defense.
He also said that “Armed Forces of Pakistan expect that justice will be dispensed in line with Constitution of Islamic Republic of Pakistan”.
Right now Musharraf is in Dubai and this judgement is given in his absence.
